Terms of Service
Effective [EFFECTIVE DATE]
These Terms are an agreement between you and [OPERATOR] ("we," "us") for using the Wyn app and website ("Wyn"). By tapping "I agree" in the app, or by using Wyn, you agree to these Terms and our Privacy Policy. If you don't agree, don't use Wyn.
Please read section 15: it requires most disputes to be resolved by individual arbitration rather than in court, and waives class actions. You can opt out within 30 days.
1. Who can use Wyn
- You must be at least 18 years old and able to form a binding contract.
- Give accurate information and keep your login secure. You're responsible for activity on your account.
- Don't create accounts to get around a block or a ban, or to impersonate anyone.
- You may not use Wyn if you're barred from receiving US software or are located in a country subject to a US embargo.
2. Stakes, money, and the law
Wyn helps friends set up challenges, agree on a stake, and keep track of results and who owes what. A stake can be a dollar amount, a task, a favor, or anything else participants agree to.
- Wyn never holds, moves, or pays out money. No one deposits anything with Wyn, and Wyn doesn't process payments. When a stake is a dollar amount, Wyn only records the figure and works out who owes whom. Any payment happens between participants, outside the app.
- Stakes are private arrangements between participants. We are not a party to them, we don't enforce them, and we aren't responsible for whether anyone pays or follows through. "Settled" in Wyn only means a participant marked it that way.
- You are responsible for following the law where you and the other participants are. Laws on betting between individuals vary by place, and some prohibit it. Don't use Wyn for any wager that is illegal for you or anyone in the challenge, or to run betting as a business, take a cut, or bet with strangers for profit.
- Stakes must be agreed to freely by everyone involved and must be legal and safe. No stake may involve violence, self-harm, dangerous stunts, illegal acts, sexual acts, or anyone under 18. Don't pressure anyone to drink alcohol. Anything involving alcohol is only for people of legal drinking age.
- Odds, chances, ratings, and standings in the app are estimates for fun, not predictions or advice.
3. Results and disagreements
Depending on how a challenge is set up, the host declares the result, participants enter scores, or the group votes. We don't decide who really won or settle disagreements between users, and we're not liable for an incorrect result, a vote you lost, or an amount someone says you owe. You can delete your account at any time, whether or not anything is settled (Privacy Policy, section 7).
4. Your content
"Your content" means anything you post: challenges, stakes, picks, scores, photos, videos, posts, comments, and messages.
- You own your content. You give us a worldwide, non-exclusive, royalty-free license to host, store, copy, display, and adapt it (for example, resizing a photo), only to operate and improve Wyn. This license ends when you delete the content or your account, except for copies other participants already received, records needed to keep shared challenges accurate, and backups.
- You confirm you have the rights to everything you post, and permission from anyone shown in a photo or video.
- You're responsible for your content. We don't pre-screen it, but we may remove any content at any time.
5. Community rules: zero tolerance
There is no tolerance for objectionable content or abusive users. You may not post or do anything that:
- Harasses, bullies, threatens, humiliates, or targets anyone, including through a stake or a forfeit;
- Is hateful, discriminatory, sexually explicit, violent, or gory;
- Involves or sexualizes anyone under 18;
- Promotes self-harm, dangerous challenges, drug use, or underage drinking;
- Shares someone's private information or images without consent;
- Is spam, a scam, impersonation, or infringes someone else's rights;
- Breaks the law, or tries to hack, scrape, overload, reverse engineer, or get around the security or limits of Wyn.
6. Reporting, blocking, and enforcement
You can report posts, comments, chat messages, and accounts, and block other users, from the ••• menu on their profile or content, or by long-pressing a chat message. You can also email [CONTACT EMAIL]. Reports are anonymous to the person you report. A block hides each of you from the other's posts, comments, reactions, chat messages, and search, and removes any follows between you.
We review reports within 24 hours and remove content that breaks these Terms. We may suspend or permanently ban the user who posted it. We may suspend or terminate any account that violates these Terms, at our discretion and with or without notice.
7. AI features
Optional AI features suggest challenge drafts, titles, ideas, presets, and scores. We ask for your permission before you first use them. Suggestions may be inaccurate or inappropriate, so review them before you save anything. You're responsible for what you confirm and post. Don't put sensitive information about yourself or anyone else into an AI feature. See Privacy Policy section 4 for what is sent and to whom.
8. Third-party services
Wyn works with services we don't control, such as Sign in with Apple, Sign in with Google, and push notification services. Their own terms apply, and we're not responsible for them.
9. Our app and your license
We own Wyn, including its software, design, and name. We grant you a personal, revocable, non-exclusive, non-transferable license to use Wyn for your own non-commercial use, in line with these Terms and, on iOS, Apple's Usage Rules. You may not copy, sell, modify, or build a competing product from Wyn. If you send us feedback or ideas, we may use them freely without owing you anything.
10. Changes to Wyn and to these Terms
Wyn is in active development. We may add, change, or remove features, or stop offering Wyn, at any time. If we change these Terms materially, we'll ask you to review and accept the new version in the app before you continue using Wyn.
11. Ending your account
You can stop using Wyn and delete your account at any time in Profile. We may suspend or end your access if you break these Terms or if we stop offering Wyn. Sections 2–4 and 9–17 continue to apply after your account ends.
12. Disclaimers
Wyn is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't guarantee that Wyn will be uninterrupted, error-free, or secure, that results, odds, ratings, amounts owed, or AI output are accurate, or that any user will honor a stake. You're responsible for your interactions with other users, online and in person.
13. Limitation of liability
To the fullest extent the law allows, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost data, lost profits, money lost on or owed under a stake, or harm arising from other users' conduct or content, even if we were told they were possible. Our total liability for any claim relating to Wyn is limited to the greater of US $50 or what you paid us in the past 12 months. Some places don't allow these limits, so they may not fully apply to you.
14. Indemnity
You agree to defend, indemnify, and hold harmless [OPERATOR] from any claims, losses, and costs (including reasonable legal fees) arising from your content, your stakes or arrangements with other users, your use of Wyn, or your violation of these Terms, the law, or anyone's rights.
15. Disputes and arbitration
- Talk to us first. Email [CONTACT EMAIL] with your claim; we'll try to resolve it informally within 60 days.
- Arbitration. If we can't, any dispute relating to Wyn will be resolved by final, binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, on an individual basis. Either of us may instead bring an individual claim in small claims court, or ask a court to stop infringement of intellectual property.
- No class actions. You and we may bring claims only individually, not as a plaintiff or class member in any class or representative proceeding.
- Opt out. You can opt out of arbitration by emailing [CONTACT EMAIL] within 30 days of first accepting these Terms.
- Governing law. These Terms are governed by the laws of the State of [STATE] and applicable US federal law. Any dispute not subject to arbitration will be heard only in the state or federal courts located in [STATE].
16. Apple App Store terms
If you downloaded Wyn from Apple's App Store:
- These Terms are between you and [OPERATOR] only, not Apple. We, not Apple, are solely responsible for Wyn and its content.
- Your license is limited to using Wyn on Apple-branded products you own or control, as allowed by the App Store Usage Rules.
- Apple has no obligation to provide maintenance or support for Wyn.
- If Wyn fails to meet an applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation regarding Wyn.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Wyn, including product liability claims, claims that Wyn fails to meet a legal or regulatory requirement, and consumer protection or privacy claims.
- If a third party claims Wyn or your use of it infringes their intellectual property, we, not Apple, are responsible for investigating, defending, settling, and discharging that claim.
- You confirm you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and you are not on any US Government list of prohibited or restricted parties.
- You must comply with any third-party terms that apply when using Wyn, such as your wireless carrier's terms.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. General
These Terms and the Privacy Policy are the entire agreement between you and us about Wyn. If any part is found unenforceable, the rest stays in effect. Our not enforcing a provision isn't a waiver. You may not transfer these Terms; we may transfer them as part of a merger, acquisition, or sale of assets, or to a company we form to operate Wyn.
